1. Agreement to Terms
By accessing or using the services provided by Eagle Home Appraisal Orlando ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services Description
Eagle Home Appraisal Orlando provides professional real estate appraisal services in Orlando, Florida, and surrounding areas. Our services include, but are not limited to:
- Estate appraisals for estate planning and settlement
- Probate valuations for court proceedings
- Divorce appraisals for marital dissolution
- IRS step-up basis appraisals (date-of-death valuations)
- Residential property appraisals
- Testimony requirements discussed before booking
3. Qualifications and Compliance
Before booking, confirm the proposed appraiser, current qualifications, intended use, and applicable reporting standards for the assignment.
4. Fees and Payment
Appraisal fees are quoted on a per-assignment basis and are due upon completion of the appraisal report. Fees are determined based on property type, complexity, location, and turnaround time requirements. Rush services may incur additional fees. Payment is expected within 30 days of invoice unless otherwise agreed upon in writing.
5. Appraisal Report Delivery
Share your deadline when requesting a quote. Timing depends on scope, property access, and availability. Confirm the schedule before booking.
6. Use of Appraisal Reports
Appraisal reports are prepared for the specific purpose stated in the engagement letter. The appraisal is intended solely for the use of the client and may not be transferred to or relied upon by third parties without our written consent. Unauthorized use of the appraisal report may result in liability.
7. Independence and Objectivity
Our appraisers maintain complete independence and objectivity in all assignments. The appraisal fee is not contingent upon the value conclusion or any other outcome. We do not advocate for any party in a transaction.
8. Property Access
Clients are responsible for providing access to the subject property for inspection. If access cannot be obtained, the appraisal may be limited in scope or cannot be completed. Any limitations will be disclosed in the appraisal report.
9. Limitation of Liability
Eagle Home Appraisal Orlando shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services or appraisal reports. Our liability is limited to the amount of fees paid for the specific appraisal assignment in question.
10. Confidentiality
We maintain the confidentiality of all client information and property data. Information may only be disclosed to third parties with client consent, as required by law, or as necessary to complete the appraisal assignment.
11. Dispute Resolution
Any disputes arising from these terms or our services shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Orange County, Florida, in accordance with the rules of the American Arbitration Association.
12. Modifications to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective upon posting to our website. Continued use of our services after any changes constitutes acceptance of the modified terms.
13. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
